Dr. Ash Bender Toronto IME Complaints: Allegations of Biased Reports

Consumer Alert: Allegations of Biased IME Reports and Unprofessional Conduct Against Toronto’s Dr. Ash Bender

When navigating a disability or workplace injury claim, claimants expect an Independent Medical Evaluation (IME) to be fair, thorough, and objective. However, recent public consumer reports have raised serious questions about the practices of Dr. Ash Bender (Ashley Bender), a Toronto-based physician who conducts evaluations for major insurance providers and public sector employers.

Multiple claimants have come forward on consumer advocacy platforms to share troubling experiences, accusing the physician of unprofessional behavior, medical inaccuracies, and writing biased reports designed to undermine legitimate insurance claims.

Who is Dr. Ash Bender?

Operating out of Spadina Avenue in Toronto, Ontario, Dr. Ash Bender is frequently retained to perform Independent Medical Evaluations for major entities, including Manulife Financial, RBC Insurance, the Ontario Public Service (OPS), and the Ontario Public Service Employees Union (OPSEU).

Rather than acting as a traditional treating physician, Dr. Bender’s role in these cases is to assess claimants on behalf of insurance companies and employers to determine the validity and severity of their medical conditions.

Questions Surrounding Clinical Restrictions and Objectivity

One of the most concerning allegations raised in recent consumer reports involves the scope of Dr. Bender’s medical practice. According to a claimant who contacted the regulatory College, Dr. Bender is reportedly not permitted to treat patients directly; instead, his medical practice is strictly limited to conducting paid Independent Medical Evaluations (IMEs).

The complainant alleges that because of this financial arrangement, Dr. Bender routinely produces false and biased medical reports in exchange for compensation. Rather than providing an objective clinical assessment, his evaluations are allegedly tailored to favor insurance providers and employers with the primary goal of undermining and denying legitimate insurance claims.

“It felt as though he was dismissive and only wrote reports based on what the Ontario Public Service and OPSEU instructed him to say. I believe he is more focused on undermining insurance claims rather than providing an objective evaluation.” — Excerpt from Consumer Report

Allegations of Hostile and Unprofessional Behavior

Beyond the clinical findings, claimants have described the atmosphere during Dr. Bender’s evaluations as hostile and degrading. In a detailed report filed regarding an IME for Manulife and the Ontario Public Service, a claimant alleged that Dr. Bender:

  • Raised his voice and insulted the patient during the examination.

  • Mocked the claimant and subsequently accused the claimant of mocking him in return.

  • Completely dismissed documented injuries, stating there was nothing wrong with the patient despite ongoing medical treatment.

  • Made derogatory remarks about the claimant’s treating physicians and union officials, allegedly using offensive language to describe OPSEU leadership and members.

Claims of Fabricated Medical Histories in RBC Insurance Evaluations

A second claimant echoed these concerns in a separate update involving RBC Insurance. After attending an IME alone—expecting a fair assessment—the patient discovered through the College of Physicians and Surgeons that Dr. Bender was compensated directly by the insurer, raising immediate red flags regarding his impartiality.

According to this second report, Dr. Bender’s final assessment contained significant factual errors:

  1. Unperformed Tests: He allegedly documented the results of medical tests that were never actually conducted during the appointment.

  2. Inaccurate Medical History: He provided a distorted account of the patient’s background while minimizing previous hospitalizations and severe illnesses.

  3. Complete Denial of Illness: Despite documented hospitalizations, the report concluded that the claimant had no medical conditions, effectively giving the insurer grounds to deny the claim.

The Bigger Picture: The Controversy Around Paid IMEs

The allegations against Dr. Ash Bender highlight a growing systemic issue within the insurance industry. While IMEs are legally intended to provide an unbiased medical snapshot, critics and disability lawyers often point out the inherent conflict of interest when an evaluator’s sole source of income comes from insurance companies. When doctors rely exclusively on insurer referrals, claimants often feel “set up to fail” before they even step into the examination room.

What Claimants Can Do to Protect Themselves

If you are scheduled for an Independent Medical Evaluation with a third-party physician, consumer advocates recommend taking the following precautions:

  • Bring a Witness: Whenever legally permissible, bring a trusted friend or family member to observe the interaction and take notes.

  • Document the Timeline: Note the exact time the doctor enters and leaves the examination room.

  • Request the Full Report: Always ask for a copy of the completed IME report and review it alongside your primary treating physician to identify any factual inaccuracies or unperformed tests.

Dr Ash Bender – Toronto, Ontario, Canada

Dr Ash Bender, Ashley Bender, Bendover, Ass Bender, Annoying, raised his voice and insulted me during IME for Manulife Financial, OPSEU and Ontario Public Service . Denied and downplayed my injuries and said there is nothing wrong with me. Has a history of lying on reports for the Ontario Public Service. 416-535-8501 Toronto Ontario, Canada

I had a negative experience with a doctor associated with Manulife, OPSEU, and the Ontario Public Service while managing my insurance claim. I was surprised to learn that OPSEU was compensating him to deny my illness, which was unexpected.

After contacting the College, I discovered that Dr. Bender is not permitted to treat patients due to his limited scope in Independent Medical Evaluations (IME), as he is compensated for his services.

I appreciate the information provided by a representative from the College.

In my interactions with Dr. Bender, I found him to be unprofessional. He often made fun of me and then accused me of mocking him in return. It felt as though he was dismissive and only wrote reports based on what the Ontario Public Service and OPSEU instructed him to say. I believe he is more focused on undermining insurance claims rather than providing an objective evaluation.

My experience with him and the situation with Manulife has been frustrating and disappointing. He mentioned he would make recommendations to my doctor, but ultimately, he had nothing of value to add to my treatment.

It is important to note that he does not appear to be objective or independent in his evaluations. I feel that his approach has disrupted my treatment and has not been helpful in addressing my needs.

He badmouthed my doctors and my Union then implied the OPSEU Female president was Obese, unattractive and Lazy and referred to OPSEU members as hopeless vermin to see if I was listening.

I left burning with anger. But this report will expose this lying pile of trash.
